§ 1. General provisions
- These Terms set out the rules for using the Student Open website, available at https://studentopen.pl, and the StudentOpen mobile app for iOS and Android (together: the “App”), including the rules for tournament registration, payment and refund of entry fees, and the OpenPoints programme. These are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on the Provision of Electronic Services (ustawa o świadczeniu usług drogą elektroniczną).
- The service provider is Free Construction spółka z ograniczoną odpowiedzialnością (a Polish limited liability company) with its registered office in Warsaw, ul. Złota 7 lok. 28, 00-019 Warszawa, Poland, entered in the register of entrepreneurs of the National Court Register (KRS) under number 0000290444, NIP (tax ID) 5272561169, REGON 141105698 (the “Service Provider”).
- The Service Provider can be contacted by e-mail at info@studentopen.pl. This address is also the point of contact for users and for the authorities of Member States, the European Commission and the European Board for Digital Services within the meaning of Articles 11 and 12 of Regulation (EU) 2022/2065 of the European Parliament and of the Council. Contact is possible in Polish and English.
- The processing of personal data is governed by the privacy policy available at https://studentopen.pl/polityka-prywatnosci.
- The terms of cooperation between the Service Provider and clubs that organise tournaments in the App are set out in separate agreements.
- These Terms are made available free of charge in the App in a way that allows them to be downloaded, stored and printed.
§ 2. Definitions
- The terms used in these Terms mean:
- User – a person using the App, in particular one who has an Account;
- Account – a User's individual account in the App;
- Consumer – a User who is a consumer within the meaning of Article 22¹ of the Polish Civil Code, and also a natural person concluding a contract directly related to their business activity where the content of the contract shows that it is not of a professional nature for that person;
- Club – a club or sports facility where Tournaments are played and which uses the App to organise them;
- Organiser – a Club and the persons acting on its behalf in the App who are responsible for running a Tournament, and where the Tournament is organised by the Service Provider – the Service Provider;
- Tournament – a tournament, league round or other sports event announced in the App;
- Entry Fee – the fee for taking part in a Tournament;
- OpenPoints – points of the loyalty programme run in the App;
- Content – texts, photos and other materials published in the App by Users and Clubs.
§ 3. Services and technical requirements
- Through the App, the Service Provider provides in particular the following services:
- maintaining the Account;
- providing information about Tournaments, leagues, results, rankings and player profiles;
- registration for Tournaments, including in pairs, with guests and on the waiting list;
- handling payments and refunds of Entry Fees;
- recording results, calculating player levels and maintaining rankings;
- running the OpenPoints programme and exchanging points for rewards;
- the community, i.e. publishing and liking posts and following Clubs and players;
- sending notifications and messages by e-mail, push notifications and the in-app inbox.
- Using the App is free of charge. Only participation in Tournaments for which an Entry Fee has been set is paid.
- To use the App, you need a device with internet access and an up-to-date web browser with JavaScript and cookies enabled, or a device running a version of iOS or Android supported by the mobile app, and to create an Account also an active e-mail address.
- The contract for services consisting in browsing the publicly available content of the App is concluded when you start using the App and terminates when you stop using it. The contract for maintaining the Account is concluded for an indefinite period when the Account is created.
§ 4. Account
- An Account is created by entering an e-mail address and the one-time code sent to that address. The App does not use passwords. To register for a Tournament you must provide your first and last name and, for Tournaments that require it, your gender.
- An Account may be created by a person who is at least 16 years old. A minor may register for Tournaments with an Entry Fee only with the consent of their legal guardian.
- The App is aimed primarily at students, but other people may also use it, unless the Organiser restricts participation in a given Tournament.
- The User must provide true information, have only one Account and not share it with other people.
- The User may delete the Account at any time in the profile settings or by requesting it at info@studentopen.pl, which terminates the contract for maintaining the Account. When the Account is deleted:
- registrations for upcoming Tournaments are cancelled, and Entry Fees are refunded in accordance with § 8;
- the OpenPoints collected and any unused coupons are forfeited;
- the first and last name in past results and rankings is replaced with an anonymous label.
- The Service Provider may terminate the contract for maintaining the Account and delete the Account with immediate effect if the User commits a gross or persistent breach of these Terms, in particular by publishing illegal content or entering false results. For other important reasons, such as the App ceasing to operate, the Service Provider may terminate this contract with 14 days' notice.
§ 5. Rules of use and Content
- It is forbidden to use the App in a manner contrary to the law, good practice or these Terms, in particular:
- providing illegal content, content that infringes the personal rights or copyright of others, or content that is offensive, harassing or misleading;
- sending spam and unsolicited commercial information;
- impersonating other people or Clubs;
- registering other people for Tournaments without their consent;
- entering false match results;
- interfering with the operation of the App, circumventing its security measures and automated data scraping.
- Users may publish Content to the extent made available in the App, in particular under Tournaments in which they took part. Community Content is publicly visible, including to people who are not logged in.
- By publishing Content, the User declares that they hold the rights to it and that the people shown in photos have consented to the dissemination of their image. The User grants the Service Provider a free, non-exclusive licence, without territorial limitation, to display the Content in the App, including on screens at Clubs, for as long as it is published in the App.
- The User may delete Content they have published at any time. They may also block another User or hide posts from a chosen Club.
§ 6. Reporting Content and moderation
- Anyone may report Content or a User that they believe breaches the law or these Terms – using the “Report” function in the App or at info@studentopen.pl. The report should identify the Content concerned (for example by providing a link) and explain why it is illegal or breaches these Terms. A report sent by e-mail should also include the reporting person's name and e-mail address and a statement that the report is made in good faith.
- The Service Provider handles reports promptly, diligently, in a non-arbitrary and objective manner. Decisions are made by people, not by automated systems.
- If a breach is found, the Service Provider may remove the Content and, in the case of gross or repeated breaches, delete the Account in accordance with § 4(6).
- The Service Provider informs the reporting person and the User concerned by the decision of the decision and the reasons for it by e-mail, unless it does not know their e-mail address.
- A decision may be appealed within 6 months by writing to info@studentopen.pl. The Service Provider considers the appeal within 14 days. This does not exclude the right to pursue claims in court.
§ 7. Tournaments and registration
- Tournaments are announced in the App by Clubs or by the Service Provider. The Tournament description includes in particular the date and venue, the format, the number of places, the Entry Fee and payment method, and any player level or gender requirements set by the Organiser.
- The Organiser may set additional rules for running the Tournament in its description, for example concerning warm-up, balls and lateness. These rules apply to matters not governed by these Terms. The provisions of these Terms on payments and refunds of Entry Fees take precedence over the Organiser's rules.
- If the Organiser has restricted participation in a Tournament to players of a certain level, a player outside that range may request a place, and the Organiser decides whether to accept them.
- By registering a partner or guest, the User declares that they have that person's consent.
- Once all places are taken, you may join the waiting list if the Organiser has made one available. A place that becomes free is offered to people on the list in the order in which they joined and is held for acceptance for the time stated in the offer message. An offer that is not accepted within that time expires and the place goes to the next person.
- Once the registration is confirmed, the User receives by e-mail a ticket with a QR code, which they show when entering the Tournament.
- The Organiser may cancel a Tournament, in particular if the number of registered people is lower than the minimum stated in the Tournament description. Participants are informed of this by e-mail. If the date or venue of the Tournament changes significantly, a participant may withdraw with a full refund of the Entry Fee regardless of the deadline set out in § 8(6).
- Match results are entered by the Organiser or by the players. A result entered by a player may be disputed by the opponent, and disputes are resolved by the Organiser.
- Player levels and rankings are calculated automatically from results and are for information only.
§ 8. Entry Fees, payments and refunds
- The party to the contract for participation in a Tournament whose Entry Fee is paid online in the App is the Service Provider. In Tournaments where the Entry Fee is paid on site, the payment is received by the Organiser, and refunds are settled with the Organiser in accordance with this section.
- The Entry Fee is stated in Polish zloty (PLN) as a gross amount and is charged per person. A User who registers a pair pays the Entry Fee for both people.
- Online payments are handled by the payment operator Stripe. The available payment methods, including BLIK, Przelewy24 and payment card, are shown at the time of payment.
- An Entry Fee payable online must be paid at registration. The place is reserved for the time stated in the App. If the payment is not received within that time, the reservation expires. If the payment is received after the reservation has expired and there is no longer a free place, the Entry Fee is refunded.
- The contract for participation in a Tournament is concluded when the registration is confirmed. Confirmation of the registration is sent by e-mail.
- A participant may withdraw from a Tournament in the App. If they withdraw at least 24 hours before the start of the Tournament, they receive a full refund of the Entry Fee. If they withdraw later or do not show up at the Tournament, the Entry Fee is not refundable.
- If one person in a pair withdraws from a Tournament, the refund covers the Entry Fee for that person and goes to the person who made the payment.
- If a Tournament is cancelled, participants receive a full refund of the Entry Fee.
- Refunds are made within 14 days of the withdrawal or cancellation of the Tournament, using the same payment method as was used for the payment, and at no cost. The time it takes for the refund to be credited depends on the bank or payment operator.
- A Consumer does not have the right to withdraw from a distance contract for participation in a Tournament, because it is a contract for a service related to a sports event for which a specific date of performance has been set (Article 38(1)(12) of the Polish Consumer Rights Act of 30 May 2014 (ustawa o prawach konsumenta)). This does not limit the right to withdraw from a Tournament under paragraphs 6–8.
- On request sent to info@studentopen.pl, the Service Provider issues an invoice for an Entry Fee paid online.
- The Service Provider may grant selected people, for example league participants, the right to take part in Tournaments free of charge.
§ 9. OpenPoints programme
- Participation in the OpenPoints programme is voluntary and free of charge. Every Account holder takes part in it automatically.
- OpenPoints are awarded for activity, not for sporting results, in particular for attending a Tournament, completing a Tournament, matches played, submitting feedback on a Tournament and, once, for completing the profile. The number of points for each activity and the daily points limit are shown in the App. Points for a Tournament are awarded after it ends, no later than within 14 days.
- OpenPoints have no monetary value. They cannot be exchanged for money or transferred to another Account.
- OpenPoints can be exchanged for rewards from the catalogue in the App. Rewards are offered by Clubs, which set their cost in points, quantity, availability period and collection conditions. The reward is provided by the Club that offers it.
- After an exchange, the points are deducted from the balance and the User receives a coupon with a QR code, which can be redeemed once at the Club that issued the reward, within the period stated in the App. The User may cancel an unused coupon, and a coupon that is not used in time expires. In both cases the points are returned to the balance.
- The Service Provider may correct the OpenPoints balance if points were awarded by mistake or obtained in breach of these Terms, for example by entering fictitious results.
- The Service Provider may end the OpenPoints programme by informing Users at least 30 days in advance. Until the programme ends, collected points can be exchanged for available rewards.
§ 10. Notifications and messages
- Messages necessary for using the Account and taking part in Tournaments, including login codes, registration confirmations, waiting-list place offers and information about Tournament cancellations and refunds, are always sent.
- Other messages, including reminders, feedback requests, information about new Tournaments from followed Clubs and messages from Organisers to Tournament participants, are sent by e-mail, as push notifications or to the in-app inbox, according to the notification settings in the User's profile.
- Messages from Organisers to Tournament participants are solely organisational (for example changes to times or courts, information about how the Tournament is running) and may not contain commercial information. By accepting these Terms, the User agrees to receive such messages from the Organisers of Tournaments they have registered for.
§ 11. Complaints
- Complaints about the operation of the App, payments, Entry Fee refunds or the OpenPoints programme may be submitted to info@studentopen.pl. A complaint should include the e-mail address linked to the Account, a description of the problem and the expected resolution.
- The Service Provider responds to a complaint by e-mail within 14 days of receiving it.
- The Service Provider is liable to the Consumer for the conformity of the services provided in the App with the contract under the rules set out in the Polish Consumer Rights Act.
- A Consumer may use out-of-court complaint and redress procedures, in particular by asking a municipal or district consumer ombudsman (rzecznik konsumentów) for help, or by applying to the provincial inspector of the Trade Inspection (Inspekcja Handlowa) to initiate mediation proceedings. Information on this is available on the website of the Office of Competition and Consumer Protection (UOKiK) at https://polubowne.uokik.gov.pl.
§ 12. Liability
- The Service Provider makes every effort to keep the App running without interruption. For technical reasons, in particular maintenance work, access to the App may be temporarily restricted, and where possible the Service Provider gives advance notice of this.
- The Service Provider is not liable for Content published by Users and Clubs if it does not know that the Content is illegal and, upon becoming aware of it, promptly disables access to it.
- The Club where a Tournament is played is responsible for the condition of the facility and for the running of the Tournament on site. Participants should assess whether their health allows them to take part in the Tournament.
- These Terms do not exclude or limit the Service Provider's liability towards Consumers to the extent that the law does not permit this.
§ 13. Changes to the Terms
- The Service Provider may change these Terms for important reasons, such as changes in the law, changes to the App's features, security considerations, changes to the Service Provider's details or a decision of a competent authority.
- The Service Provider informs registered Users of changes to these Terms by e-mail or by a notice in the App at least 14 days before the changes take effect. A User who does not accept the changes may delete their Account before that date.
- Registrations for Tournaments made before the changes take effect are governed by the previous version of these Terms.
§ 14. Final provisions
- Matters not governed by these Terms are subject to Polish law. The choice of Polish law does not deprive a Consumer of the protection afforded by the mandatory provisions of the law of the country of their habitual residence.
- Disputes with Consumers are resolved by the courts having jurisdiction under general rules. Disputes with Users who are not Consumers are resolved by the court having jurisdiction for the Service Provider's registered office.
- These Terms are also available in an English version. In the event of any discrepancy between the versions, the Polish version prevails.
